These terms apply when you browse, bid, make an offer or buy on KeyFinale (keyfinale.com). "KeyFinale", "we" and "us" mean KeyFinale. By using the site you agree to these terms, our Privacy Policy, our Refund Policy and our Shipping Policy.

1. How KeyFinale works

Each event has its own KeyFinale page, run for the organization named on it. Items on an event page come from one of three places:

  • KeyFinale items, which we supply ourselves or through vetted partners. We handle checkout, shipping and customer service for these.
  • The organization's own items, which are offered and delivered by that organization. Each listing makes this clear.
  • Travel packages and experiences, which are delivered as a certificate with booking instructions.

Every sale is credited to the event you bought it from. The organization receives its share as described on the event page.

2. Prices and the buyer's premium

You pay the item price, plus:

  • a buyer's premium on the item price (usually 5%, or 3.5% on travel packages; each event page shows its exact rate);
  • shipping on items we ship;
  • any applicable sales tax.

The buyer's premium is KeyFinale's and does not reduce the organization's share. Every charge is shown before you pay.

3. Buy Now

Buy Now purchases the item at the listed price. Your purchase is complete when payment succeeds. Until then, someone else can still buy the item.

4. Make an Offer

  • An offer is a request to buy at your price. By sending it you agree to the buyer's premium, shipping and tax that apply.
  • We may accept, decline or counter any offer.
  • If an offer is accepted or countered, we email you a link to pay. You must pay by the deadline in that email; after the deadline the offer expires and the item is released.
  • An item is yours only once an accepted offer has been paid for.
  • If you give a mobile number and agree to texts, we text you only about that offer. Message and data rates may apply. Reply STOP to opt out.

5. Bidding

  • A bid is a binding commitment to buy the item at that amount, plus the buyer's premium, shipping and tax, if you win.
  • You may set a private maximum, and we will bid for you only as much as needed, up to that amount.
  • Some items have a minimum (reserve) that must be met before they sell.
  • If you win, we email you a link to pay. You must pay within 48 hours. If you don't, we may offer the item to the next-highest bidder and may restrict your ability to bid in the future.
  • Where an item also has Buy Now, buying it ends the auction for that item.

6. Event timing

  • Buying, offers and bids are open between an event's start and end times.
  • When an event ends, or the organization or KeyFinale closes it, no new purchases, offers or bids are accepted.
  • Any order placed against a closed event, or through a checkout that can't credit an event, may be cancelled and refunded in full.

7. Items, authenticity and descriptions

  • We describe items as accurately as we can. Colors and sizes may look different on your screen.
  • Hand-signed items include the authentication or documentation described in the listing. Some framed pieces carry a printed (facsimile) signature; the listing always says so.
  • Our guarantees are described in the Refund Policy.
  • Items an organization offers itself are described, delivered and guaranteed by that organization.

8. Payment

  • Payments are processed securely by our payment provider, Stripe. KeyFinale never sees or stores your full card number.
  • You confirm that you are authorized to use the payment method you provide.
  • If you dispute a charge with your card issuer without first contacting us, we may restrict your future purchases.

9. Shipping and travel

Shipping times, damage in transit and travel booking are covered in our Shipping Policy. If a shipped item arrives damaged, contact us within 14 days of delivery and we will make it right under our guarantee.

10. Refunds

Because each purchase is tied to a live event, sales are generally final, except as set out in our Refund Policy.

11. Taxes and donations

You receive an item or experience in exchange for your payment, so purchases are generally not tax-deductible charitable donations. Please consult your tax advisor. Gifts made through an event's Donate link are made directly to the organization and are governed by its own terms.

12. Your conduct

Don't use KeyFinale to place bids or offers you don't intend to honor, to bid on your own items to raise the price, to interfere with the site, or for anything unlawful. We may cancel bids, offers or orders, or block access, if we believe these terms have been broken.

13. Limits of liability

To the fullest extent the law allows, KeyFinale's total liability for any claim about a purchase is limited to the amount you paid for that purchase. We are not liable for indirect or consequential losses. Nothing in these terms limits rights you have under consumer law that can't be waived.
